These Terms of Service (“Terms”) govern your access to and use of the Artemas Quibble website, products, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.
1. Introduction
Artemas Quibble (“we,” “our,” “us,” or the “Company”) operates this ecommerce platform to offer luxury accessories and related products. The Service includes our website at www.artemas-quibble.com and all related online and offline retail services.
By accessing or using the Service, you agree to comply with and be bound by these Terms, including all policies incorporated by reference.
2. Authorization for Shopify and Approved AI Distribution
Notwithstanding anything to the contrary in these Terms:
Artemas Quibble expressly authorizes Shopify, Inc. and its designated commerce partners to access, transmit, display, and facilitate the purchase of Artemas Quibble products solely through Shopify’s authorized Agentic Storefronts and similar AI-driven commerce channels.
This limited authorization allows product discovery and purchase functionality in those approved partner environments. It does not grant rights to any other third party outside of these explicitly authorized channels.
3. Prohibited Conduct
You agree not to engage in any of the following:
A. Automated Access and Data Extraction
• Accessing or using any automated system, scraper, spider, bot, crawler, or similar technology to extract, copy, mine, index, replicate, or harvest content, product information, pricing, images, or any data from the Service for any purpose.
• Using our content or product information to train or refine any machine learning models, generative AI systems, or similar automated technologies, except as expressly permitted under Section 2 above with Shopify’s authorized channels.
B. Marketplace Listing and Unauthorized Resale
• Republishing, listing, or offering Artemas Quibble products for sale on third-party marketplaces (including Amazon, eBay, Walmart Marketplace, or any similar marketplace) without prior written authorization from Artemas Quibble.
• Transmitting, redistributing, copying, or otherwise exploiting any part of the Service or its content for commercial purposes outside the authorized channels referenced in Section 2.
C. Circumvention of Safety Measures
• Attempting to circumvent, disable, or otherwise interfere with any security, privacy protections, content restrictions, or access controls used in the Service.
Violation of any prohibited conduct constitutes a material breach of these Terms and may result in termination of access and pursuit of legal remedies.
4. Intellectual Property Rights
All content, product designs, trademarks, logos, images, text, graphics, and software appearing on the Service are the exclusive property of Artemas Quibble or its licensors.
No rights are granted to copy, reproduce, distribute, display, or create derivative works from our content, except for personal shopping use or as authorized through Shopify’s approved commerce channels.
5. Products, Orders, and Pricing
• All products displayed through the Service are subject to availability.
• We reserve the right to correct errors, inaccuracies, or omissions and to cancel or refuse orders at any time.
• Prices are subject to change without notice.
6. Payment and Taxes
You agree to pay all charges associated with your orders at the time the order is placed. You are responsible for any applicable taxes associated with your purchases.
7. Disclaimers and Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
• The Service is provided “AS IS” and “AS AVAILABLE.”
• Artemas Quibble disclaims all warranties, express or implied.
• Artemas Quibble shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Service.
8. Termination
We may suspend or terminate access to the Service at any time, including for violations of these Terms.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Missouri, United States. Any disputes shall be brought exclusively in the courts of St. Louis County, Missouri.
10. Amendments
Artemas Quibble reserves the right to update or modify these Terms at any time. Continued use of the Service after such updates constitutes acceptance of the revised Terms.
